Defense Rests In Floyd County Murder Case

{Prestonsburg, Kentucky}...Wednesday morning, defense council for Berry Hall announced that they had rested their case. Floyd County Circuit Court Judge Johnny Ray Harris then asked the prosecution if they had any rebuttal evidence to submit, and Commonwealths Attorney Arnold Brent Turner replied “no.” Judge Harris decided to give the jurors a day off, and resume court Thursday to hear the closing arguments of both the prosecution and the defense. Hall is on trial for the 2008 double murder of his niece, Lisa Tackett and her husband, Alan Tackett. The defense has tried to convince the jury that Hall, because of depression and anxiety, was not mentally stable at the time of the shooting. Hall took to the stand in his own defense Monday and told jurors that the blame was that of Dr. Charles Hieronymous who treated him for depression. The prosecution has attempted to prove that despite Hall's depression he was still aware of the criminality of his actions, and he showed intent to kill Lisa and Alan Tackett. Hall is on trial for capital murder, and if found guilty, he could be sentenced to death.
